Up Energy Drink accused of trademark infringement

A post over at Northern California Record has been brought to our attention that you’ll definitely want to check out as well if Christian Guzman’s recently released Up Energy Drink had your interest. The company behind Up Energy Drink has had a complaint filed against it by Uptime Sports Nutrition Inc. and Uptime Energy Inc.

Based on the post over at North California Record, it seems the two companies are claiming to have suffered damages from the launch of Guzman’s still very new energy drink using a confusingly similar mark. They are seeking “monetary relief, actual damages, profits, punitive damages, enhanced damages, interest, all legal fees and any other relief as the court deems just.”
